These Terms of Service ("Terms") govern your use of the mobile applications and services provided by Digital Awesome, Inc. ("Digital Awesome," "we," "us," or "our"). By using our apps or services, you agree to these Terms.
1. Services
Digital Awesome provides white-labeled mobile applications for retail and loyalty programs, hosted at digitalawesomeapps.com. Our apps allow users to authenticate, manage loyalty accounts, and interact with participating retailers.
2. SMS and Text Messaging
Program description: By providing your phone number and tapping Continue on the login screen, you consent to receive one-time SMS passcodes (OTPs) from Digital Awesome for login authentication and phone number verification.
Message frequency: Typically 1 message per login attempt. Additional messages may be sent for phone number verification.
Rates: Message and data rates may apply. Check with your mobile carrier for details.
To cancel: Reply STOP to any message to opt out. You will receive a confirmation message and no further messages will be sent to that number. Note: opting out of SMS will prevent you from receiving OTPs, which are required to log in.
For help: Reply HELP to any message, or contact us at support@digitalawesomeapps.com.
Supported carriers: Most major US carriers are supported. Carrier availability may vary.
Carrier liability: Carriers are not liable for delayed or undelivered messages.
Data: Your phone number and opt-in consent are not shared with third parties for marketing or any other purpose. See our Privacy Policy for full details.
3. User Accounts
You are responsible for maintaining the confidentiality of your account. Do not share OTP codes with anyone. Digital Awesome will never ask you for your OTP via phone, email, or chat.
4. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Attempt to gain unauthorized access to any part of our platform
- Interfere with or disrupt the integrity or performance of our services
5. Intellectual Property
All content, trademarks, and technology on our platform are owned by Digital Awesome or its licensors. You receive a limited, non-transferable license to use our apps for personal, non-commercial purposes.
6. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the fullest extent permitted by law, Digital Awesome is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
8. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Disputes shall be resolved in Spokane County, Washington.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
